Hukuk İngilizcesinde Dolaylı Anlatım (Reported Speech in Legal English)

Hukuk alanında çalışırken bazı hallerde olaya, işleme veya davaya ilişkin kişilerin ne söylediklerini kağıda dökmek gerekebilir.

Birçok belgede bu çeviriler yapılırken Zaman Kipleri hatalı şekilde dönüştürülmekte ve Kişi Zamirleri değiştirilmemektedir. Bu hususlarda bazı kereler hak kayıplarının da yaşandığı gözlemlenmektedir.

Bazı durumlarda, hukukçuların, bildirilen veya dolaylı bir konuşma gerektiren bir ifade, rapor veya beyanname hazırlamaları gerekebilir.

Aşağıdaki tabloda geçmiş zamana ait ifadelerin ne şekilde dolaylı anlatıma çevrildiğini görüyoruz.

Tırnak içindeki şimdiki/geniş zaman fiili geçmiş zamana çevrilir (bir derece Past Kuralı) ve kişi zamiri uygun şekilde değiştirilir.

Aynı şekilde tırnak içindeki ifade geçmiş zaman fiili ise bu fiil Past Perfect Tense zaman kipine dönüşür ve yine kişi zamiri uygun şekilde değiştirilir.
Emir cümleleri için yapılması gereken fiilin mastar şeklini kullanmaktır. Olumsuz emirlerde fiilin mastar halinin önüne “not” getirilir.

Type of Speech Direct (present)	Simon said, “I’m in my fourth year of law school.”
Reported (from past conversation)	Simon said *he was* in his fourth year of law school.	Present tense from direct speech changes to past tense. Pronouns change.
Type of Speech Direct (past)	David said, “She showed me how to use the Internet.”
Reported (from pasl conversation)	David said she had shown him how to use the Internet.	Past statement to past perfect. Pronouns change.
Type of Speech Direct (imperative-order)	Evan said to Peter, “Bring me the file right now!”
Reported (from past conversation)	Evan told Peter to bring him the file immediately.	Reported (from past conversation)
Type of Speech Direct (negative imperative)	Evan said to Peter, “Don’t put the evidence there!”
Reported (from past conversation)	Evan told Peter not *to put* the evidence on the table.	Imperative changes to not + infinitive. Verb changes to tell. Specific location is named instead of there.

Bu tabloda ise Modal fiillerinin nasıl dönüşüm geçirdiğini görüyoruz.

Ana fiiller ise değişmeden aynı şekillerini korurlar. Kişi zamiri uygun şekilde değiştirilir.
Must fiili için iki tür olasılık mevcuttur.
Could, would gibi modallar dolaylı anlatıma çevrilirken değişmezler. Whether ya da If eklenmelidir. Kişi zamiri uygun şekilde değiştirilir.

Type of Speech (Direct future)	Linda said, “Joan will bring me the file later today.”
Reported (from past conversation)	Linda said Joan would bring her the file later that day.	Will changes to would, Pronouns change. Main verb doesn’t change.
Type of Speech Direct (present)	The judge said, “Mr. Samny must repay his client.”
Reported (from past conversation)	The judge said that Mr. Sammy had to/must repay his client.	Must changes to had to or stays must. Can use that but not necessary. Main verb doesn’t change.
Type of Speech Direct (present)	The lawyer asked the judge “Could we have a ten-minute recess?”
Reported (from past conversation)	The lawyer asked the judge, if they could have a ten-minute recess.	Add if or whether. Pronouns change. Main verb does not change.

Son tablomuzda şimdiki zamana ait ve her daim gerçek/ evrensel doğrulara ait ifadelerin dolaylı anlatıma ne şekilde dönüştüğünü görüyoruz.

Şimdiki zaman fiili aynı şekilde korunur ve sadece kişi zamiri uygun şekilde değiştirilir.
Evrensel gerçeklik ifadelerinde ise ana fiil ya da kişi zamiri değiştirilmeden dolaylı anlatım ifadesi kurulabilir. That eklenmesi isteğe bağlıdır.

Type of Speech Direct (present)	My professor says to me, “Your class will be the best ever.”
Reported (in present conversation)	My professor Says our class will be the best ever.	Only the pronouns change.
Type of Speech Direct (“always true”)	Yesterday our civics instructor told us, “The United States is not a democracy but a republic.”
Reported (in past conversation)	Yesterday our civics instructor told us that the United States is not a democracy but a republic.	No change in verb or pronouns. Can use it but not necessary.
