This office is responsible for providing opinions on cases tried by the Council of State as the court of first instance. Council of State prosecutors also work within the General Prosecution Office.

Tutor: Very good. Now, let’s move on to the Regional Administrative Courts. What is their function and how are cases handled in these courts?

Alex: The Regional Administrative Courts review and decide on appeals against decisions made by administrative and tax courts. They also resolve jurisdictional conflicts between these courts. Cases in the Regional Administrative Courts are heard by a panel of 3 judges – a presiding judge and two member judges. Currently, there are eight Regional Administrative Courts operating across Turkey.

Tutor: Well done, Alex. Now, let’s delve into the Courts of First Instance – the Administrative Courts and the Tax Courts. Can you explain their general functions and how cases are handled in these courts?

Alex: Certainly, Professor. Administrative courts handle cases related to the annulment of administrative decisions and claims for damages caused by such decisions. They generally have a panel of 3 judges, but cases below a certain monetary threshold are ruled by a single judge. Tax courts, on the other hand, deal with cases related to the Law No. 6183 on the Collection of Public Receivables. Similar to administrative courts, they also have a panel of 3 judges, with the option of a single judge for cases below a certain monetary threshold.
